This website is owned and operated by The Talavera Hub LLC (“The Talavera Hub,” “we,” “us,” “our”). These Terms & Conditions (the “Terms”) govern your access to and use of https://thetalaverahub.com (the “Site”) and any purchases or services made through the Site.

By visiting, browsing, using, creating an account, submitting a request, or placing an order through the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Definitions

  • “Customer,” “you,” “your”: any person or business using the Site.

  • “Products”: items offered for sale on the Site, including handmade and imported artisan goods.

  • “Wholesale/Custom Orders”: orders placed through quotes, bulk requests, or made-to-order production terms.

2) Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page and the “Last Updated” date will change. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

3) Use of the Site (License + Rules)

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal or internal business purposes.

You agree not to:

  • copy, reproduce, distribute, or exploit Site content without permission,

  • use scraping, bots, automated extraction, or data-mining without written consent,

  • attempt to bypass security, disrupt the Site, or interfere with other users,

  • use the Site for unlawful purposes or to violate any applicable law.

We may suspend or restrict access to the Site for violations or suspected abuse.

4) Accounts, Passwords, and Accuracy

If you create an account, you agree to provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account.

We may suspend or terminate accounts at our discretion, including for fraud, misuse, chargeback abuse, or violation of these Terms.

5) Product Information & Handmade Variations

We make reasonable efforts to display Products accurately, but:

  • colors may vary by screen/device,

  • dimensions may have slight variance,

  • handmade items naturally vary in shape, glaze, brushwork, and pattern.

Handmade variation is normal and expected and does not automatically qualify as a defect.

6) Pricing, Taxes, and Errors

Prices are shown in the currency displayed on the Site. Prices may change at any time.

We are not responsible for typographical errors, pricing errors, or system mistakes. If a listed price is incorrect, we may cancel the order and refund amounts paid, or contact you to confirm whether you wish to proceed at the corrected price.

Taxes may be collected where required. You are responsible for any taxes, duties, customs fees, brokerage fees, or import charges unless we explicitly state otherwise.

7) Orders, Payment, and Authorization

By placing an order, you represent that:

  • you are authorized to use the payment method,

  • the billing and shipping information is accurate,

  • and you agree to pay all charges associated with the order.

Payments may be processed by Shopify and/or third-party payment providers. We reserve the right to:

  • refuse any order,

  • limit quantities,

  • cancel orders suspected of fraud or abuse,

  • require identity verification for high-risk orders.

8) Shipping & Delivery (General Retail Orders)

Shipping timelines provided are estimates and not guarantees. Carrier delays, weather, customs inspections, and other events may affect delivery.

Risk of loss for standard retail orders may vary depending on shipping method and applicable law; we will work with customers in good faith when issues arise, consistent with our published policies.

9) Returns, Refunds, and Exchanges (Retail Orders)

Retail returns/refunds (if offered) are governed by our Return Policy and any other posted policies. If there is a conflict between these Terms and the Return Policy, the Return Policy controls for returns/refunds.

10) Wholesale & Custom Orders

Wholesale and custom orders are governed by our Wholesale & Custom Order Policy (the “Wholesale Policy”), including deposit terms, final-sale terms, handmade variation expectations, damage allowance, shipping terms, and claims requirements.

If there is any conflict between these Terms and the Wholesale Policy, the Wholesale Policy controls for wholesale/custom transactions.

11) Insurance (Wholesale/Custom Shipments)

If you place a wholesale/custom order, insurance and risk/claim terms are governed by the Wholesale Policy. Customers are responsible for reading and complying with those terms, including any requirement that the customer request insurance (and our right to require it for certain shipments).

12) User Content (Reviews, Photos, Messages)

If you post reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for marketing and business purposes (unless prohibited by law).

You agree not to post unlawful, defamatory, or infringing content. We may remove content at our discretion.

13) Third-Party Links and Services

The Site may link to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Use third-party sites at your own risk.

14) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted access, error-free operation, or that defects will be corrected.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TALAVERA HUB LLC AND ITS OWNERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOSS OF GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.

IN ALL CASES, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM, EXCEPT WHERE PROHIBITED BY LAW.

Some jurisdictions do not allow certain limitations—so some parts may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless The Talavera Hub LLC from any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising from:

  • your violation of these Terms,

  • your misuse of the Site,

  • your violation of law,

  • your infringement of intellectual property or other rights.

17) Termination

We may suspend or terminate your access to the Site at any time for any reason, including suspected fraud, abuse, or violation of these Terms. Sections that should survive termination (including limitation of liability, indemnity, and governing law) will survive.

18) Governing Law & Venue (California)

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the Site must be brought in the state or federal courts located in Riverside, California, and you consent to personal jurisdiction and venue there.

19) Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

20) Entire Agreement

These Terms, along with our posted policies (including Return Policy, Shipping Policy, Privacy Policy, and Wholesale Policy), constitute the entire agreement between you and The Talavera Hub regarding your use of the Site.
